KAYAK RENTAL AGREEMENT AND WAIVER OF LIABILITY
This agreement is entered into between Mountaineer Dynamics Institute (hereinafter referred to as "the Company") and the undersigned participant (hereinafter referred to as "the Renter").
1. Assumption of Risk The Renter acknowledges that kayaking involves inherent risks, including but not limited to the risk of injury, death, or damage to personal property. The Renter understands and agrees to assume all risks associated with kayaking, whether they are caused by the actions of the Renter or by others.
2. Release of Liability In consideration for the rental of the kayak(s) and associated equipment, the Renter agrees to release, waive, discharge, and hold harmless the Company, its employees, agents, and representatives from any and all liability, claims, demands, or causes of action for personal injury, property damage, or wrongful death arising out of or related to the use of the kayak(s) and equipment.
3. Responsibility for Equipment The Renter acknowledges responsibility for the rented kayak(s) and associated equipment during the rental period. The Renter agrees to return all equipment in the same condition as received, except for normal wear and tear. The Renter understands that they are financially responsible for any loss, theft, or damage to the kayak(s) or equipment during the rental period.
4. Damages The Renter agrees to reimburse the Company for the cost of any damages to the kayak(s) or equipment, including but not limited to cracks, punctures, loss of paddles, life jackets, or other rental gear. The Renter will be charged the full repair or replacement cost for any damaged or lost equipment, including labor, as determined by the Company. The Renter also acknowledges that any damage to the kayak(s) may result in a delay in the return of the equipment and/or additional charges.
5. Indemnification The Renter agrees to indemnify and hold harmless the Company for any claims, damages, or losses caused by the Renter's actions or omissions, including but not limited to damage to property, personal injury, or accidents that occur during the rental period.
6. Governing Law This agreement shall be governed by and construed in accordance with the laws of the state of Florida.
7. Acknowledgment of Understanding By signing this agreement, the Renter affirms that they have read and fully understand the terms and conditions stated above, and that they voluntarily accept the risks associated with kayaking and the responsibility for the rental equipment.
